1. Introduction
Welcome to EquitableSharedSpace ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at equitablesharedspace.sbs (the "Service") operated by EquitableSharedSpace.
By confirming a charter or utilizing our Service, you acknowledge your acceptance of these Terms. Should you not agree with any part of these terms, you are not authorized to use the Service.
2. Service Overview
EquitableSharedSpace offers upscale yacht charter services, which include, but are not confined to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Our services are provided based on availability and prevailing weather conditions. We maintain the right to alter or cease offerings at any given time.
3. Booking and Reservations
3.1 Booking Process
To successfully arrange a charter, you are required to:
- Confirm you are at least 18 years old
- Provide truthful and comprehensive details
- Provide the mandatory deposit identified in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is affirmed only after receipt of the payment and our formal confirmation. We hold the discretion to decline service to anyone.
3.3 Availability
All charters are dependent upon the availability of the vessel and favorable weather conditions. We endeavor to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All prices are stated in € and include applicable taxes, except when specified otherwise. We reserve the right to modify prices without prior notice.
4.2 Payment Schedule
- Deposit: A sum amounting to 50% of the total cost of the charter, to be paid at the time of booking
- Balance: To be settled 48 hours prior to the departure of the charter
- Additional charges (if applicable): To be paid upon completion of the charter
4.3 Payment Methods
We accept principal credit cards, bank transfers, and verified cheques. Our payment procedures are handled through secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund, excluding processing fees
- 24-72 hours before departure: Half of the amount is refunded
- Under 24 hours before departure: No refund accorded
5.2 Weather Cancellations
When weather conditions are considered unsafe by our captain, we propose to:
- Rearrange your charter to a subsequent available date without additional cost
- Issue a full refund when rescheduling is impractical
5.3 Mechanical Issues
If there are mechanical issues with the vessel designated for you, we will strive to assign an adequate alternative. Should an alternative not be available, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers must:
- Comply with instructions from the crew
- Utilize provided safety gear when necessary
- Inform about any medical conditions that could influence safety
- Stay within the designated sections of the vessel
6.2 Prohibited Items
The following are not allowed aboard:
- Glass containers
- Illegal materials
- Firearms or weapons
- Pets (unless with prior approval)
6.3 Conduct
Travelers must behave respectfully. In the event passenger behavior constitutes a safety threat or disrupts others, we retain the right to end the charter prematurely with no refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the charter cost paid by you. We are not liable for:
- Injuries arising from passenger negligence
- Theft or damage to personal belongings
- Indirect, consequential, or punitive damages
- Delays due to weather or events beyond our control
7.2 Insurance Coverage
Our operations and vessels are covered by extensive marine insurance. Passengers should possess their own travel and personal insurance.
7.3 Assumption of Risk
Partaking in our charter services signifies that you understand that maritime activities carry inherent dangers and you accept responsibility for your own safety and security.
8. Modifications and Itinerary Changes
We reserve the right to modify itineraries, routes, or schedules due to weather, safety, or operational necessities. We shall attempt to provide a comparable alternative experience whenever possible.
9. Force Majeure
We are excused from liabilities for any delays, cancellations, or modifications caused by events outside our control, including but not restricted to:
- Severe weather events
- Natural calamities
- Government directives
- Closures of ports
- Vessel malfunctions
10. Privacy and Data Protection
We handle your personal details in line with our Privacy Policy. By utilizing our services, you consent to the compilation and use of your data as specified in the Privacy Policy.
11. Intellectual Property
All materials on our website, including text, imagery, logos, and graphics, are safeguarded by copyright and trademark protections. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
The Terms are under the jurisdiction of the laws in Montenegro. Any disputes will be adjudicated in the courts of Tivat, Montenegro.
13. Changes to Terms
We may revise these Terms at our discretion. Updated Terms will be published on our website and feature a new revision date. Continual use of our services implies adherence to the amended terms.
